1. Use of the Site

3. Renderings, Floor Plans, and Community Information

The Site includes architectural renderings, floor plans, site plans, elevations, photographs, and descriptions of homes and communities. This information is for illustrative purposes only.

  • Renderings and illustrations are artistic representations and may not depict the actual home as built. Colors, materials, finishes, landscaping, views, and other details may vary.
  • Floor plans, square footage, and dimensions are approximate and subject to change without notice. Actual dimensions of constructed homes may vary.
  • Community features, amenities, and site plans are conceptual and subject to modification, substitution, or elimination without notice.
  • Photographs may show model homes, decorator items, upgrades, and landscaping that are not included in the base price of a home.
  • Pricing, availability, incentives, and specifications are subject to change without notice. "Starting from" pricing reflects the base model and excludes upgrades, options, and lot premiums unless otherwise stated.

Nothing on the Site constitutes an offer to sell or a solicitation of an offer to buy real estate. All sales are subject to a fully executed purchase agreement. Prospective buyers should rely on their own inspection and the representations contained in the purchase agreement, not on Site content.

4. No Warranties

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

We do not warrant that the Site will be error-free, secure, or free from viruses or other harmful components.

5. Limitation of Liability

To the fullest extent permitted by law, Gallery Homes, LLC and its affiliates, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total liability arising from or related to these Terms or your use of the Site will not exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to the jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
